DRUNK DRIVING ARREST ESCALATES INTO FIRST DEGREE ASSAULT CHARGE

An arrest for alleged drunk driving can bring down an alarming set of criminal charges on the defendant. One of the unhappiest consequences of being arrested for drunk driving is the speed with which the drunk driving charges can escalate into more serious accusations. A recent arrest for drunk driving that occurred on Airport Boulevard shows how quickly a drunk driving charge can turn in to a serious charge for assault.

THE INCIDENT

The defendant in this case was traveling westbound on Airport Boulevard at about 3:30 a.m. when her vehicle veered into a construction zone occupied by workers and construction equipment. Officers responded to the area after receiving reports of a vehicle a person having been struck by a vehicle. When police arrived, they discovered the defendant’s vehicle in the construction zone. The car had apparently struck a paving machine with flashing lights in the construction zone.

Further investigation revealed that the vehicle had also hit a construction worker. The worker was taken to a nearby hospital for treatment of his injuries that were apparently non-life threatening. The driver of the wayward vehicle was also taken to a hospital for treatment of minor injuries. While being treated, the woman was discovered to have been impaired at the time of the accident.

She was transported to Mobile County Metro Jail and charged with first-degree assault and driving under the influence of alcohol.

WHAT COULD HAPPEN?

If convicted, the defendant will face a severe sentence, including a significant period of incarceration, a fine, and a severe restriction on her driving privileges.
